Accurate Information Requirement

Under the DMCA, you must swear to the truthfulness of your infringement notice under penalty of perjury. Deliberately providing false information in a sworn declaration is a federal crime (See U.S. Code, Title 18, Section 1621) and could lead to civil liability.

Investigation Prior to Filing

We understand the effort and passion our users invest in their content on Tala Partners LLC platforms. Therefore, we urge you to thoroughly investigate and consult with an attorney before submitting a DMCA takedown request. We recommend contacting the user directly as a first step.

No Automated Bots for Takedown Notices

Each takedown notice should be individually assessed by a trained professional. If you’re outsourcing this process, ensure that your representatives do not use automated bots for bulk submissions, as these are often invalid and result in unnecessary content removal.

Counter Notices Users affected by your takedown notice have the right to submit a counter notice. If they do, we will restore their content within 14 days unless you inform us of legal action taken against the user related to the content on Tala Partners platforms.

Tala Partners’ Role

Tala Partners LLC discretion in this process is limited to verifying whether the notices meet the DMCA’s minimum requirements. The evaluation of claims’ merits is the responsibility of the involved parties and their attorneys, with an emphasis on the requirement for notices to be made under penalty of perjury.

Submitting a DMCA Takedown Notice

To file a DMCA takedown notice for content on Tala Partners, please email info@talapartners.com. Include a plain-text version of your letter in the email body, and you may attach a document if necessary. Your notice should include:

1) A physical or electronic signature of the copyright owner or their authorized representative.
2) Identification of the copyrighted work claimed to be infringed.
3) Identification of the infringing material and sufficient information to permit us to locate the material.
4) Your contact information, including address, telephone number, and email.
5) A statement of good faith belief that the use of the material is not authorized.
6) A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
